Terms And Conditions

GENERAL TERMS AND CONDITIONS

These terms and conditions are the agreement between the AGENCY ("you") and Pearl Travels ("us").

This website belongs to Pearl Travels a wholesale receptive tour operator.

Pearl Travels products are subject to these general terms and conditions & shall be sold exclusively to Tour Operators and Travel Agents. The access to this program is strictly controlled by PEARL TRAVELS.

The AGENCY shall be able to get accommodation, transfer, sightseeing tours, cruises, car hire, group special offers and other services through the Pearl Travels website.

WEBSITE ACCESS

This agreement for access to this program is entered into directly by and between PEARL TRAVELS and the AGENCY.

By visiting, using or ordering from the website www.pearltravels.com, the AGENCY agrees to be bound by the following Terms and Conditions and to follow these Terms and Conditions and all applicable laws and regulations governing this website and reservations transacted via www.pearltravels.com  

ACCESS CODES

Access codes (agency code ID) to this program shall be given by PEARL TRAVELS to the AGENCY. The user name & password can be set by the User directly only the User Code will be system generated

Access codes provided by PEARL TRAVELS are for the sole use of the AGENCY and no access code use may be transferred or disclosed.

In the event of improper use thereof, such access codes shall be withdrawn; sales will immediately be stopped and legal action may be taken. And all outstanding payments will be immediately due

For reasons of security, PEARL TRAVELS shall reserve the right to change the access codes so long as such changes shall not disrupt the use of the system and that sufficient notice of the planned change(s) is received.

WEBSITE USE

You agree to be bound by the following terms of trading on the Site:

- The Site is available to you for making legitimate hotel bookings only, not for speculative, false or fraudulent Bookings - You accept financial responsibility for all transactions made under your AGENCY log-in and you agree to give us accurate information on all people travelling on a Booking.
- Before you click on the confirm button, please ensure that you have carefully read all the terms and conditions. By clicking on the confirm button you are committing to be bound by these terms and conditions.

BOOKING PROCEDURE

Bookings can be made by any of the following ways:

It is the AGENCY's responsibility to check all details of the Booking including Customers’ names, arrival date, departure date, number of nights, hotel name and rooms booked. The Company needs to be informed immediately of any errors as we cannot guarantee to be able to make corrections at a later date.

PRICES

The prices offered on www.pearltravels.com are confidential and may not be disclosed.

All rates mentioned on our website are Nett & Non-Commissionable to you

Prices quoted on www.pearltravels.com are based on per room per night including applicable taxes & meal plan as advised. All rates in this tariff are based on F.I.T. agreement.

Any extra services with regards to accommodation are not included such as telephone calls, insurance, laundry service, minibar, parking, etc. which shall be paid directly by the final consumer.

All rates include current applicable hotel taxes. Any tax increases after this date will be added to the published rates.

Hotel categories listed in this tariff are not official and are the opinion of PEARL TRAVELS

Similar hotel rates do not signify similar category.

UPDATES & ALTERNATE HOTELS

PEARL TRAVELS will confirm alternate hotels if possible when the requested hotel is not available.

Please advise in advance if passengers do not want any alternate hotel.

All confirmations are considered final for requested or alternate hotels. If a hotel confirmed is not acceptable to you or your passenger, PEARL TRAVELS must be advised to cancel. Or else resulting no show charges will be billed to you.

PEARL TRAVELS will periodically issue updates adding, deleting or changing information and rates in this tariff. Updates supersede any information in this tariff.

AMENDMENTS

If you need to change the dates of travel, there may be other rates valid for the new dates requested. If the hotel cannot accommodate your requested amendment, the Booking will automatically revert to its original status although the Company will always endeavour to offer a suitable alternative.

VOUCHERS

PEARL TRAVELS will issue system generated vouchers with the Agency Logo & details (if the same is fed into the system while registering). Vouchers will mention “Booked and Payable by Pearl Travels”

Pearl Travel will not be responsible for any vouchers issued without confirmation from Pearl Travels. All vouchers must be issued for services exactly as confirmed by Pearl Travels.

Passengers with vouchers issued incorrectly or issued for services not confirmed by Pearl Travels may be charged directly by hotels or service suppliers at their current rates.

CHILDREN’S POLICY

A maximum of two children will be free when sharing with two full paying passengers. This policy may vary from hotel to hotel. All Family Plan policies are based on using existing bedding in the room. Free children will be determined by the policy of each hotel. Exact ages of children must be advised, children cannot be confirmed without ages. They will be confirmed as full paying adults.

SPECIAL REQUESTS
Special requests to hotels such as non smoking or adjoining rooms will be passed on but cannot always be confirmed or guaranteed. Disabled rooms usually have wheelchair access but may not include features for the seriously disabled. An email should be sent to pearl@pearltravels.net if a disabled room is required so that the hotel can be informed. Disabled rooms are on request and the Company cannot be held responsible if an adapted room is not provided upon arrival.
HOTEL FACILITIES

The AGENCY hereby acknowledges that the availability of the facilities and features listed for each hotel are under the direct control of the hotel and as such the Company cannot be held responsible if those facilities or features are not made available to the Customer during the period of their stay. If a facility or feature is of particular importance to the Customer, then the AGENCY should check with the Company or the hotel that this facility or feature will be available during the dates of the Customer’s stay.

Please note that, in particular, swimming pools and air conditioning are only available seasonally and it is the AGENCY’s responsibility to check whether these facilities will be available during the Customer’s stay.

LATE ARRIVAL

If a Customer is going to arrive at the hotel after 1700 Hours, it is advisable to call them (the phone number is indicated on the email confirmation) and let them know.

TRADE FAIR RESERVATIONS

During trade fairs or festivals hotels may not honour our usual reduced contracted rate, which means that the price you pay may be higher than the hotel’s published rate. This can happen at any time when availability is scarce.
Cancellation charges may vary to those laid down in the cancellation policy in accordance with terms laid down by our suppliers. The Company reserves the right to alter this charging structure in such circumstances.

ROOM TYPES

It is the AGENCY’s responsibility when making a Booking to ensure they have booked the correct room type for their Customer. All details of the room types and the number of people that can be accommodated in the room are available on the search screen and should be double checked on your email confirmation. Room types available are as follows:-

Single Room - Contains one single bed. Suitable for one person

Twin Room - Suitable for two people. Please note that in the US and Canada twin/double is the opposite of the European definition. Double or twin rooms may only contain one bed. Customers can request separate beds upon arrival, however separate beds are not guaranteed.
Double Room - Contains one double bed or two single beds made up as a double. Suitable for two people. In the US and Canada, a double room may contain two double beds.
Double for sole use - Contains two single beds or one double bed. Suitable for one person
Triple Room - Contains twin or double bed + extra bed or 2 double beds. Most hotels do not have one full size bed for each guest. Suitable for 3 people.
Quad Room - Please note that the room may not contain four single beds. Room may contain two double beds. Suitable for four people.
Child Bed - often a roll away bed, suitable for a child under the age of 18 years
Cot, cradle or crib - suitable for a child under the age of 2 years
(Please be aware that room type and size will vary from hotel to hotel)

PAYMENT

Agencies who have not established credit/billing privileges, a floating deposit or a Bank Guarantee will be required to pre pay all bookings.

Pearl Travels must receive full payment at least 07 days prior to arrival. Non-payment will result in automatic cancellation. Passengers will not be accepted unless full payment has been received by Pearl Travels. Any resulting inconvenience to passengers will not be the responsibility of Pearl Travels.

BANK CHARGES: WE WILL CREDIT THE AMOUNT WE RECEIVE NET OF ALL BANK CHARGES TO THE ACCOUNT.  ENSURE ALL BANK CHARGES ARE ABSORBED BY THE PAYEE

CANCELLATIONS

Pearl Travel will confirm all services on a booking. We reconfirm all bookings, changes and cancellation.
Booking agent is responsible for checking that our confirmation is received for all booking changes and cancellations. If you do not receive confirmation for the cancellation or change you must re-send your message. Cancellations are not valid without our written confirmation.

Pearl Travels will charge for cancellations based on the following schedule except where hotel policies specify otherwise.

Cancellation time is counted from time of notification by Pearl Travels to hotels.
From 4 - 14 days:  No charge except National Parks.
3 days to arrival: Charges applicable as per terms mentioned in the booking
NO SHOWS: Charges for one night unless there are additional charges by hotels.

CLAIMS & ADJUSTMENTS

Claims for refunds and adjustments must be made within 45 days of passenger's departure. Claims must be accompanied by full details and documentation.

If passenger cancels a hotel directly, they must supply cancellation number or hotel employee name, date and time cancelled.

If passenger is asked to pay directly, they should call Pearl Travels immediately. Any receipts or proof of payment must be submitted to Pearl Travels.

Hotels may charge penalties for cancellation or reduction of room nights after arrival.

Pearl Travels reserves the right to substitute hotels of equal or superior grade when necessary.

Pearl Travels will not pick up or assume any reservation at a hotel which was not booked through our office.

In case of excessive changes, additional communication fees may be charged

RESPONSIBILITY

Pearl Travels acts only as agents for the passenger in regard to travel Pearl Travels does not manage or control or operate any transportation vehicle, any hotel or any supplier of services and therefore assumes no liability for injury, loss, or damage, accident, delay or irregularity which may be caused by defect in any vehicle or for any reason whatsoever, or through acts or default of any company or person engaged in carrying out the arrangements.

OFFICE HOURS
Pearl Travels reservation office hours are Monday – Saturday from 1000 – 1800 hours India local time. Messages received after these hours are not valid until the next business day. Messages sent to us on Saturday for changes or cancellation for Sunday or Monday arrivals may not be acted on and may be subject to No Show or cancellation charges.
FORCE MAJEURE
The Company does not accept liability or pay compensation for any loss, damage or expense for any failure in the course of this contract due to a force majeure. This shall include, without limitation, any service which we or any of our suppliers could not provide due to war, threat of war, riots, civil strife, terrorist activity, industrial action, natural or nuclear disaster, fire, adverse weather conditions, closure of airports or ports, governmental intervention, accidents or technical problems with transport.
PRIVACY POLICY
The Company only uses Customers' personal data for the purpose of processing and operating Bookings. The Company has in place appropriate technical and organizational security measures against unauthorized or unlawful processing of personal data and against accidental loss or destruction of, or damage to, personal data.
CHANGES TO TERMS AND CONDITIONS

The Company reserves the right to change or update these terms and conditions relating to the use of the Site without prior notice to you. The latest version will always be available on the Site and by using the Site; you are accepting the latest version available.

INTELLECTUAL PROPERTY

The copyright, trademarks and other intellectual property rights in and relating to the Site are reserved to the Company. The content or data found on the Site may not be reproduced, sold, transferred or modified without the prior written consent of the Company. You may not modify, copy, duplicate, display, reproduce, license, publish, transfer or sell any information, software, products or services obtained from the Site without the prior written consent of the Company. You must further acknowledge that you must not use any of these intellectual property rights, except whilst making a booking as set out in these terms and conditions.

SYSTEM INTEGRITY

The usage of any device, routine or software that inhibits or interferes with the running of the Company or any booking concluded upon it is prohibited. Any action which creates a load on the Company or infrastructure that may be considered unreasonable or disproportionate is prohibited.

ACCESS TO THE SITE
The Company reserves the right to deny access to the Site at any time as it may be affected by outside factors outside of our control.  
GENERAL

1. A copy of this agreement should be signed and returned as confirmation of your acceptance of the terms and conditions contained in this agreement.
2. Prior to signing this agreement, you are kindly requested to read carefully the different policies mentioned above, which form the basis of this agreement.
3. Initial each and every page to acknowledge full agreement.
4. Attach a copy of the Company Trade License.
5. Contract to be returned to Pearl Travels.
